1. Acceptance of Terms
By accessing or using ListConnect AI ("the Service"), including our mobile application, web portal, and website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
ListConnect AI is a software platform that helps real estate professionals create AI-powered property listings. The Service includes:
- AI-powered video analysis to extract property details.
- AR-assisted room measurement.
- AI-generated property descriptions.
- PDF export of property listings.
- A web portal for managing and viewing listings.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
- Providing accurate and up-to-date information.
You must notify us immediately if you suspect unauthorized access to your account.
4. AI Credits and Payments
4.1 AI Credits
Certain features of the Service require AI Credits, a virtual currency purchased through the platform. AI Credits are used for video analysis, AI-generated descriptions, and room measurements.
4.2 Purchases
All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. AI Credits are non-refundable except as required by applicable law.
4.3 Credit Expiration
AI Credits do not expire. They remain in your account until used or until your account is closed.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload content that is fraudulent, misleading, defamatory, or violates the rights of others.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Access the Service through automated means (bots, scrapers, etc.) without our permission.
- Share your account credentials with third parties or allow multiple individuals to use a single account.
6. Intellectual Property
6.1 Our Property
The Service, including its design, features, code, and branding, is owned by ListConnect AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
6.2 Your Content
You retain ownership of all content you upload to the Service (property data, photos, videos, text). By using the Service, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service to you.
6.3 AI-Generated Content
Property descriptions and other content generated by AI through the Service are provided for your use. You are responsible for reviewing and verifying AI-generated content before using it in any listing, publication, or communication.
7. Disclaimers
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- AI-generated descriptions and property analysis are for informational purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
- AR room measurements are approximations. They should not be relied upon as exact measurements for legal, construction, or appraisal purposes.
- We do not guarantee uninterrupted or error-free access to the Service.
8. Limitation of Liability
To the maximum extent permitted by law, ListConnect AI and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us. Upon termination:
- Your right to use the Service will immediately cease.
- Any unused AI Credits will be forfeited unless otherwise required by law.
- We may delete your data in accordance with our Privacy Policy.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you via email or in-app notice. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
